Terms of Service

These Terms of Service ("Terms") govern your access to and use of the AutoMarketIQ website at automarketiq.com and related services (collectively, the "Service") operated by AutoMarketIQ ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
The Service is intended for use by licensed new-car dealers and dealership groups in the United States. By using the Service, you represent that you are authorized to act on behalf of a licensed motor vehicle dealership.
2. Account registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
3. Subscription and billing
AutoMarketIQ Pro is billed at $149/month. Enterprise pricing is custom-quoted. All subscriptions are billed monthly via Stripe. You may cancel at any time from the Stripe billing portal; cancellation takes effect at the end of the current billing period.
New accounts start with a 7-day free trial. A valid payment method is required at signup. If you do not cancel before the trial period ends, your payment method will be charged automatically.
4. Permitted use
The data provided through the Service is licensed to you for internal business purposes only — specifically, competitive pricing intelligence for your dealership or dealer group. You may not:
- Resell, sublicense, or redistribute the data to third parties
- Use the data to contact, identify, or target individual buyers
- Scrape, bulk-download, or programmatically extract data beyond the Service’s intended interface (API access requires an Enterprise plan)
- Use the Service for any unlawful purpose
5. Data and PII
Transaction data displayed in the Service is sourced from verified buyer submissions through our sister platform, CarWhere. All personally identifiable information (buyer name, address, SSN, driver’s license number, lender account numbers) is automatically redacted before display. You agree not to attempt to re-identify any buyer from redacted data.
6. Your dealership’s data
Your own dealership’s transactions are automatically excluded from your competitor views. You will never see your own deals in competitor rankings. However, other subscribers may see redacted transactions from your dealership as part of their competitive intelligence.
7. Intellectual property
The Service, including its design, features, and data analysis methodology, is the intellectual property of AutoMarketIQ. Your subscription grants you a limited, non-exclusive, non-transferable right to access the Service for the duration of your active subscription.
8. Disclaimers
The Service is provided "as is" and "as available." We do not warrant that the data is complete, accurate, or error-free. Transaction data reflects buyer-submitted records and may contain errors or omissions. You are solely responsible for pricing decisions made using the Service.
9. Limitation of liability
To the maximum extent permitted by law, AutoMarketIQ’s total liability to you for any claim arising from or related to the Service shall not exceed the total amount you paid us in the twelve (12) months preceding the claim.
10. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may close your account at any time by canceling your subscription and contacting us at info@automarketiq.com.
11. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Santa Clara County, California.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the revised Terms.
